Board of Managers Meeting Minutes, November 13th, 2012

Board Members Present:  Peter Levy, Hannah Berkin-Harper, Madeleine Milan, Katharine Flanders Mukherji, Levi McConnell.  Also Present:  Elia Malara, Managing Agent; Jose Perez, Superintendent

The meeting convened at 7:30 pm and was adjourned at 8:45 pm.

 

Superintendent’s Report

  • Work has begun to service the boilers in preparation for winter.
  • An interior brick wall of 120 Boerum Place is being re-pointed.
  • Some patching is being done on a few small areas of the roof of 120 Boerum, due to storm-related leaks.
  • The Board is looking into replacing the large rug in the entry of 120 Boerum Place.
  • Some of the carpet tiles in the hallways of 120 Boerum Place had come loose, and have now been glued down again.
  • A new access panel is being installed near the front stairs to the basement at 120 Boerum Place. This is being done to provide an access point to the large drain traps.
  • A new wooden storage shed is being built on Boerum Place, between the garage doors.
  • Water drainage solutions for 120 Boerum Place are still being investigated. The Board is seeking the opinion of a professional consultant to perform an examination of current issues.
  • The carpet in the lobby of 134 Boerum Place has been replaced.

 

  • On September 6, 2011 Unit 1E, Unit 2E, other Units, and Common Areas sustained significant water damage.  Skytrack’s investigation concluded that the root cause of the damage was the negligence of the owner of Unit 2E. Damaged or faulty plumbing within Unit 2E caused all of the damage.  Skytrack made the repairs to the Common Areas and made emergency repairs as is required and authorized by the provisions of the By-Laws.

 

The cost of repairs to common areas was billed to the owners of Unit 2E.  Skytrack made no repairs to 1E beyond the initial emergency repairs and directed the Unit 1E owners to seek compensation, if any, from their own insurance carrier and/or directly from the owners of Unit 2E.

 

CURRENT LITIGATION:

1E:  The Unit owners (Michael and Ann Marie Tedesco) disagreed with Skytrack’s determination and commenced an action in the Supreme Court-Kings County (Index No. 15179/2012) demanding damages in the sum of $20,000.00.  Initially, Skytrack’s attorney Answered the Complaint on behalf of Skytrack in order to avoid a default.  Ultimately, Skytrack’s insurance carrier stepped in to defend and, ultimately, cover potential loss. The carrier has been instructed not to settle.  The case is pending.  Skytrack’s total potential liability is the deductible in the amount of $2,500.00

2E:  The Unit owner (Derek Eller) also disagreed with Skytrack’s determination.  They have engaged counsel, but have not commenced action.  If Eller commences an action, we will turn it over to the insurance carrier.

 

Financials

  • The financial statement was reviewed and appears to be in good standing.

 

The next Board Meeting has been slated for Wednesday, December 19th, 2012.
